General Terms and Conditions By downloading any of our services, as well as continuing to browse and use this website and/or using our technology, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern "GoodSAM"s relationship with you in relation to our provided apps and website. If you disagree with any part of these terms and conditions, please do not use our technology or our website. 1. Terms 1.1 The term "GoodSAM service providers" or "us" or "we" refers to the owners of the apps and this website. The term "you" refers to the user or viewer of our website. The terms "GoodSAM (volunteer) responders" and "GoodSAM alerters" refer to users of our technology, as defined below. 1.2 "GoodSAM Responders" are for example doctors, nurses, paramedics or registered first aiders who can provide basic life support and first aid while awaiting the emergency services. They download the GoodSAM Responder App and in doing so agree to be notified of emergencies in their vicinity. Their actions are voluntary "Good Samaritan" acts and by no means replace the emergency services. 1.3 "GoodSAM Alerters" are members of the public who download our app and opt to voluntarily make use of our technology in an emergency situation, in order to receive immediate help from registered GoodSAM responders. 2. Liability: 2.1 "GoodSAM Responders" undertake "Good Samaritan" Acts in good faith as independent practitioners. Neither they nor GoodSAM Ltd are liable for actions or omissions that result from the care they provide or are unable to provide. Similarly, GoodSAM Ltd cannot be held liable for any injury or misadventure that occurs to either the responder, the alerter or any other person as a result of the use of our services, this includes but is not limited to issues relating to the malfunction of our services and technical matters relating to the GoodSAM app, GPS matters or location inaccuracies and clinical matters arising from the action or inaction of a GoodSAM user. 2.2 GoodSAM responders must establish indemnity requirements for their country and profession. Many countries / regions have a "Good Samaritan" law that protects volunteers who respond to people in life threatening conditions. Some organisations (e.g. National Health Litigation Services) cover people that work within their national health service. If not covered by such mechanisms (e.g. you a a doctor working privately) then check with your medical indemnity provider to ensure you are covered for Good Samaritan acts. 2.3 GoodSAM does not seek financial remuneration from use of the App from either Alerters or Responders and no financial remuneration will be provided to Alerters or Responders either for perceived failures in the system or for acts performed. 2.4 GoodSAM does not replace the statutory emergency services. 2.5 If you are a healthcare professional and have restrictions to your practice or have an investigation into your practice, or if you have restrictions for working with children / vulnerable patients then you must declare and de-register from GoodSAM immediately. 3. Terms of use 3.1 The use of our technology, our services and this website is subject to the following terms of use: 3.2 GoodSAM is a tool that utilizes the latest in App development and is developed to provide a rapid first aid response to critical emergencies, by connecting patients who need immediate medical attention to the nearest independently trained first aid personnel. 3.3 The use of our technology, either as a GoodSAM alerter or responder, is entirely at your own risk, for which we shall not be liable. 4. Responder Responsibilities and Agreement: 4.1 It is the responsibility of the individuals who register as GoodSAM volunteer responders to ensure that their registration with the relevant governing body is current and that they have up to date first aid and basic life support skills. Their first aid qualification must include basic life support and must not have expired. If it has expired the responder must de-register from the system until re-certified. If a responder is under any restriction or investigation into their practice or has any restrictions on working with children or vulnerable people they must de-register from the system. Evidence of up to date qualifications will be required for registration. 4.2 Although medico-legal action following Good Samaritan acts is extremely rare, responders should consider indemnity cover in addition to that provided by their employer. GoodSAM Ltd and Ambulance services including London Ambulance Service NHS Trust do not provide this cover. In the UK, if working in an NHS Trust, the NHSLA afford protection. If not working inside and NHS Trust, you should have separate indemnity (e.g. MDU / MPS). 4.3 If a user fraudulently attempts to register as a responder when they are not registered with the authority they claim to be registered with (e.g. GMC/RCN), then they will be reported to the local legal force to deal with such fraud and barred from using any GoodSAM services. 4.4 Before attending an incident you MUST ensure optimal scene and personal safety. If in doubt, await the emergency services. GoodSAM Ltd cannot be held liable for any personal injury or loss that occurs as a result of you attending an incident. 4.5 By registering as a responder, you agree that have you read and will abide by the Code of conduct, outlined below. - Code of Conduct for GoodSAM: The purpose of the GoodSAM App is to enable immediate life-saving assistance prior to the statutory ambulance service arriving. It is imperative that responders providing Good Samaritan acts do not delay transfer to definitive care. As such, the following code of conduct containing basic rules has been established: A responder must ensure that their knowledge and skills are current. If formal certification is out of date then acting as a responder must NOT occur. A responder must arrive by foot. Only in especially remote locations should driving to a location be considered and the rules of the road apply fully. Since not officially dispatched, speeding or blue light driving is not allowed. A responder should only respond if fully alert and prepared (do not respond if e.g. alcohol has been consumed) A responder MUST NOT go outside of his / her skill set. BASIC LIFE SUPPORT and AED use are all that should be provided when appropriate. Upon arrival of the statuary emergency services care MUST be handed over immediately. The respondent must ensure that their knowledge and skills are current and that they have undertaken a formal certified course in immediate life support/first aid and that such certification remains valid. If such certification lapses then a respondent should deregister from the service until it has been renewed. 5. Alerter Responsibilities and Agreement: 5.1 The GoodSAM technology is for EMERGENCY USE ONLY. This must be life or limb threatening emergencies such as: Cardiac arrest, severe trauma (e.g. road traffic accident), or peri-arrest acute medical emergencies (e.g. severe asthma). It MUST not be used for minor ailments, chronic complaints or general "help". As an alerter you agree to not use the resource unless the incident is such an EMERGENCY. Repeated use of the resource in non-emergency situations will result in your phone being barred from GoodSAM services. If your use puts responders or others in danger, the appropriate legal action will be perused and the local police force informed. 5.2 You understand that GoodSAM Ltd, the responders and other bystanders are performing "Good Samaritan" acts in good faith. Under no circumstances, if you have used the technology, will you pursue any medico-legal or other claim against GoodSAM Ltd, the responder or other bystanders. 6. Misuse of GoodSAM services: 6.1 All our GoodSAM responders and alerters devices are assigned unique identification numbers. If a user registers fake alerts or misuses the services, whether as a Responder or Alerter, their device may be banned from using the technology. Further legal action may be taken against the user if appropriate. 7. Additional terms: 7.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Privacy Policy 9.1 Your personal data is secured on our servers. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. 9.2 You may request details of personal information which we hold about you under the Data Protection Act 1998. If you would like a copy of the information held on you please email info@goodsamapp.org If you believe that any information we are holding on you is incorrect or incomplete, please email us as soon as possible, info@goodsamapp.org . 9.3 We will correct any information found to be incorrect as soon as possible after it has been brought to our attention. 10 The following terms are relevant to the GoodSAM Responders in Australia: The following 10 Code of Conduct Rules apply to the GoodSAM program and your participation in it. Please read the following carefully. 1) The Responder is responsible for their own health and safety. When the Responder is alerted via the App, it is the choice of the Responder to accept or reject the alert. Do not undertake any action or enter any situation where your, or another person's health or safety could be compromised. Phone 000 and wait for assistance if required. 2) The responder must be familiar with CPR and use of an AED and is responsible for their own knowledge and skills. The responder should utilise support from the Triple Zero call-taker to guide patient care where required. Suggested nationally-recognised training is outlined below. 3) The Responder should arrive by foot. Only in rural locations should driving to a location be considered and normal road rules still apply. Specifically, the use of hazard or warning devices is not allowed whilst responding, and there are no exemptions to state/territory road rules or any other applicable legislation as a result of being alerted via the GoodSAM platform. 4) The Responder should only respond if fully alert and prepared. Do not respond if alcohol has been consumed or whist under the influence of medication or other substances. Preparation includes the possession of any personal protective equipment you consider necessary. 5) A Responder who is not a registered health professional MUST NOT provide a response beyond a first aid skill set. When appropriate, BASIC LIFE SUPPORT and AED use are all that are to be provided. Further considerations for health professionals registered with the Australian Health Practitioner Regulation Agency (AHPRA) are outlined below. 6) Upon arrival of ambulance services, responsibility for patient care MUST be handed over immediately. Following the arrival of the Ambulance Service, Responders may continue to assist with ongoing resuscitation efforts under the leadership & guidance of the Ambulance Service if asked to do so. 7) The Responder is responsible for ensuring that their ability to act as a Responder is not impaired by any medical, physical or mental health conditions. It is recommended that you discuss any concerns (including vaccination status) with your relevant health care professional prior to registering as a Responder. Neither the relevant Ambulance Service, nor GoodSAM are responsible for any illness or injury related to your involvement in the program. 8) Participation in the GoodSAM program is voluntary. You must not seek payment, gifts, benefits or hospitality in relation to your involvement in the program. 9) Patient privacy and confidentiality is paramount. Other than to emergency services, you must not share or disclose information gained as part of a response and should familiarise yourself and abide with the legislative requirements for handling health information in your state/territory. Other than via specific functionalities provided within the GoodSAM app, the recording of video, audio or still images (photos) is not allowed during a response. In addition, information related to a patient or any part of a response must not be disclosed in the media (including social media.) Breach of this rule will result in you being automatically removed from the GoodSAM program. 10) Responders act as Good Samaritans and are not representatives of the Ambulance Service or any other organisation. Responders are responsible for their actions. If you have borrowed an AED as part of a response, you are required to return the AED to the place you collected it, unless Ambulance Service staff explicitly request to keep it. You are liable for any damage you cause to third party property. Neither the relevant Ambulance Service, nor GoodSAM are responsible for any damage or theft of property belonging to the responder which occurs in relation to a response. 10.1 First Aid Training: - First Aid Training is the successful completion and awarding of one of the below nationally recognised units of competency by a Registered Training Organisation. These include: - HLTAID001 - Provide Cardiopulmonary Resuscitation - HLTAID002 - Provide Basic Emergency Life Support - HLTAID003 - Provide First Aid - HLTAID005 - Provide First Aid in Remote Situations - HLTAID006 - Provide Advanced First Aid - HLTAID007 - Provide Advanced Resuscitation - HLTAMB008 - Assess and Deliver Standard Clinical Care In all cases, Responders must practice within the scope of the above unit of competency which they have successfully completed. Where a Responder has not completed recognised First Aid training, they should only provide CPR, use of an AED, or other care as instructed by the Triple Zero call-taker. 10.2 AHPRA Registered Health Professionals: - The skill set and practice of AHPRA Registered Health Professionals are not restricted by Rule 5 above, however AHPRA Registered Health Professionals should exercise their professional judgement in the provision of patient care with specific consideration of the following: - Their level of training, familiarity and competence in any procedure, assessment or skill. - The access, availability, familiarity, maintenance, capability or absence of appropriate; equipment, trained personnel, medications and support necessary to safely provide any procedure, assessment or skill. - The possession of adequate professional indemnity or other insurance in relation to the practice of any procedure, assessment or skill within the environment they are in. - The relative benefits and risks to the patient in comparison to awaiting the routine provision of care by emergency services. AHPRA Registered Health Professional should note that the requirements of professional conduct, including related codes and guidelines, apply and that breaches or concerns may be raised with AHPRA by the Ambulance Service or a concerned party. The purpose of the GoodSAM App is to provide immediate lifesaving assistance prior to ambulance emergency services arriving. By remembering and complying with the Rules above, we can provide lifesaving care without compromising definitive treatment. Please note that failure to follow the Rules may result in removal from the program, referral to a registering body or other action as deemed appropriate by GoodSAM or the relevant Ambulance Service. 10.3 Your Privacy: Information you provide to GoodSAM, including personal information, may be provided to the Ambulance Service in the state/territory where you utilise the GoodSAM application. This information will be stored and accessed in accordance with each organisation's Privacy Policy, details of which are available below. The Ambulance Service may contact you in relation to your involvement in the program, including any responses you participate in. The Ambulance Service may provide information relating to you and your involvement in the program to the organisation you are affiliated with in the GoodSAM database. If you are no longer affiliated with this organisation, it is your responsibility to inform us by either: - Updating your GoodSAM profile with a new affiliating organisation (or by choosing 'GoodSAM' if no other affiliating organisation is listed). - Contacting us on the details provided. 10.4 General: The Ambulance Service reserve the right to exclude individuals from the GoodSAM program where, at their sole discretion, they believe the individual has breached the Code of Conduct, or it is believed that the individual's involvement with the program is not appropriate. This Code of Conduct may be amended by GoodSAM as required, and in consultation with the Ambulance Services. The amended Code of Conduct will be published on the GoodSAM website and made available via the GoodSAM application. If you do not agree to abide by the Code of Conduct, you must not act as a responder and must cease use of the GoodSAM application. Your use of the GoodSAM application is considered to be an acceptance of the Code of Conduct as amended from time to time.
