General Terms and Conditions

By downloading any of our services, as well as continuing to browse and use this website and/or using our technology, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern "GoodSAM"s relationship with you in relation to our provided apps and website. If you disagree with any part of these terms and conditions, please do not use our technology or our website.

1. Terms

1.1 The term "GoodSAM service providers" or "us" or "we" refers to the owners of the apps and this website. The term "you" refers to the user or viewer of our website. The terms "GoodSAM (volunteer) responders" refer to users of our technology, as defined below.

1.2 "GoodSAM Responders" are people able to perform CPR and use an AED. They maybe healthcare / emergency professionals, trained first aiders or members of the public who have received training and volunteer to respond. They download the GoodSAM Responder App and in doing so agree to be notified of emergencies in their vicinity. Their actions are voluntary "Good Samaritan" acts and by no means replace the emergency services.

2. Liability:

2.1 "GoodSAM Responders" undertake "Good Samaritan" Acts in good faith as independent practitioners. Neither they nor GoodSAM Ltd are liable for actions or omissions that result from the care they provide or are unable to provide. Similarly, GoodSAM Ltd cannot be held liable for any injury or misadventure that occurs to either the responder or any other person as a result of the use of our services, this includes but is not limited to issues relating to the malfunction of our services and technical matters relating to the GoodSAM app, GPS matters or location inaccuracies and clinical matters arising from the action or inaction of a GoodSAM user.

2.2 GoodSAM responders must establish indemnity requirements for their country and profession. Many countries / regions have a "Good Samaritan" law that protects volunteers who respond to people in life threatening conditions. In the UK, cardiac responders are afforded protection through NHS Resolutions when acting within the code of conduct as agents of the UK ambulance services. If not covered by such mechanisms (e.g. you are a doctor working privately) then check with your medical indemnity provider to ensure you are covered for Good Samaritan acts.

2.3 GoodSAM does not seek financial remuneration from use of the App from Responders and no financial remuneration will be provided to Responders either for perceived failures in the system or for acts performed.

2.4 GoodSAM does not replace the statutory emergency services.

2.5 If you are a healthcare professional and have restrictions to your practice or have an investigation into your practice, or if you have any restrictions for working with children / vulnerable persons whatever your background, then you must declare and de-register from GoodSAM immediately.


3. Terms of use

3.1 The use of our technology, our services and this website is subject to the following terms of use:

3.2 GoodSAM is a tool that utilizes the latest in App development and is developed to provide a rapid first aid response to critical emergencies, by connecting patients who need immediate medical attention to the nearest independently trained first aid personnel.

3.3 The use of our technology is entirely at your own risk, for which we shall not be liable.

4. Responder Responsibilities and Agreement:

4.1 It is the responsibility of the individuals who register as GoodSAM volunteer responders to ensure that, when relevant, their registration with the relevant governing body is current and that they have up to date first aid and basic life support skills. For example, if registering as a doctor, they should ensure their national registration is current. If registering as a first aider in the UK, their training must be within date. In some territories (e.g. parts of Australia), GoodSAM responders can "self certify" that they have previously been trained and are confident that they are still able to undertake good quality CPR and use an AED.

4.2 If a responder is under any restriction or investigation into their practice or has any restrictions on working with children or vulnerable people they must de-register from the system.

4.2 Medico-legal action following Good Samaritan acts is extremely rare. In most parts of the world, indemnity insurance is not advised, however, please confirm with local authorities / emergency services for their advice.

4.3 If a user fraudulently attempts to register as a responder when they are not registered with the authority they claim to be registered with (e.g. Ahpra , then they will be reported to the local legal authorityto deal with such fraud and barred from using any GoodSAM services.

4.4 Before attending an incident you MUST ensure optimal scene and personal safety. If in doubt, await the emergency services. GoodSAM Ltd cannot be held liable for any personal injury or loss that occurs as a result of you attending an incident.

4.5 By registering as a responder, you agree that have you read and will abide by the Code of conduct for your region. The links to these codes can be found here:

5. Misuse of GoodSAM services:

6.1 All our GoodSAM responders devices are assigned unique identification numbers. If a user registers fake alerts or misuses the services, their device may be banned from using the technology. Further legal action may be taken against the user if appropriate.

8. Privacy Policy

8.1 Your personal data is secured on our servers. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

8.2 You may request details of personal information which we hold about you under the Privacy and Personal Information Protection Act 1998 NSW (PPIP Act). If you would like a copy of the information held on you, please email enquiries@instant.help. If you believe that any information we are holding on you is incorrect or incomplete, please email us as soon as possible, enquiries@instant.help.

8.3 We will correct any information found to be incorrect as soon as possible after it has been brought to our attention.


9 The following terms are relevant to the GoodSAM Responders in New South Wales:

These 10 principals protect responders and patients. They are our Code of Practice, and all New South Wales GoodSAM responders agree to follow them.

1)	Your safety is the first priority, and you should act sensibly to maintain your own health and safety. If you choose to accept an alert, do not take any action or enter a situation where your, or another person's safety is at risk. Phone Triple-Zero (000) and wait for assistance if required. You should try to ensure appropriate clothing and footwear for the scene.
2)	If more information becomes available, and NSW Ambulance determines that a volunteer response is not appropriate, you will receive a cancellation message via the app. If you receive a cancellation message, you should stop responding straight away. You may then receive a second alert if the address of the emergency has changed - you can accept and respond to the new alert.
3)	You should only accept an alert if you are fully alert. Do not respond if you have consumed alcohol, drugs, or any medications that impair alertness.
4)	You should ensure that your ability to act as a responder is not impaired by any medical, physical or mental health conditions. It is recommended that you discuss any concerns (including vaccination status) with your relevant health care professional prior to registering as a responder. NSW Ambulance and GoodSAM are not responsible for any illness or injury related to your involvement in the program.
5)	You should travel to scene by foot. Only In rural locations should driving be considered, and if driving you should obey all normal road rules. Specifically, hazard or warning devices are not allowed while responding; and there are no exemptions to the NSW road rules or other applicable legislation as a result of responding to a GoodSAM alert.
6)	You are responsible for understanding your own training, knowledge and skills; and should not provide care beyond the scope of your first-aid training. In most cases, basic life support and use of an Automated External Defibrillator will be all that is required. Please see below for advice to Ahpra registered Healthcare Professionals.
7)	Responsibility for patient care passes to NSW Ambulance paramedics or other Emergency Services as soon as they arrive. You may offer to continue to assist if required under the leadership and supervision of paramedics.
8)	Participation in the GoodSAM program is voluntary. You must not seek payment, gifts, benefits or hospitality in relation to your involvement in the program. This is an important part of your protection under the Civil Liability Act 2002 (NSW).
9)	You must always preserve the privacy and confidentiality of the patients you help. You mustn't disclose information about a patient to other people, the media, or on social media. Ambulance control-room staff may request live access to your phone's camera to assist your resuscitation; but otherwise recording video, audio or photos on your own device is not allowed. This is consistent with the Health Records and Information Privacy Act 2002 (NSW); and if you breach this rule, you will be automatically removed from the GoodSAM programme.
10)	Responders are members of the public and are not representatives of NSW Ambulance. You are responsible for your own actions; and NSW Ambulance and GoodSAM are not responsible for any theft, loss or damage of property sustained in the course of a response. If you have borrowed a Public Access Defibrillator as part of a response, you should return it afterwards.

Adhering to our code of conduct is important to protect the public and our patients, and we reserve the right to exclude individuals from the GoodSAM programme if we believe that the Code of Conduct has not been followed; or if we believe that their ongoing involvement with the programme is not appropriate. Your use of the GoodSAM app in New South Wales is considered to be an acceptance of this Code of Conduct.

10 Guidance for Ahpra registered professionals, including paramedics
Ahpra registered health professionals are responding as volunteers and are only expected to provide chest compressions and use an AED. However, should they choose to provide care beyond this level they should exercise their professional judgement with specific consideration of the following:
- Their level of training, familiarity and competence in any procedure, assessment or skill
- The access, availability, familiarity, maintenance, capability or absence of appropriate; equipment, trained personnel, medications and support necessary to safely provide any procedure, assessment or skill
- The possession of adequate professional indemnity or other insurance in relation to the practice of any procedure, assessment or skill within the environment they are in.
- The relative benefits and risks to the patient in comparison to awaiting the routine provision of care by emergency services.

Ahpra registered health professionals should note that the requirements of professional conduct, including related codes and guidelines, apply and that breaches or concerns may be raised by NSW Ambulance or a concerned party.

11 Guidance for NSW Ambulance employees:
Volunteer responders who are also NSW Ambulance employees should follow all normal NSW Ambulance policies and work-practices.  If you are alerted while on operational duty, you should decline the alert, and await tasking by the Control Centre as there may be a closer NSWA resource.
Once a tasked paramedic attends, clinical decision-making sits with the tasked paramedic crew. You should ensure that you use appropriate personal protective equipment (PPE) when it becomes available.

Information you provide to GoodSAM, including personal information provided to NSW Ambulance will be stored and accessed in accordance with our privacy policy available at:

NSW Ambulance may contact you in relation to your involvement in the program, including any responses you participate in.

NSW Ambulance may provide information relating to you and your involvement in the program to the organisation you are affiliated with in the GoodSAM database. If you are no longer affiliated with this organisation, it is your responsibility to inform us by either:
- Updating your GoodSAM profile with a new affiliating organisation (or by choosing 'GoodSAM' if no other affiliating organisation is listed)
- Contacting us using the details provided below.


12  General:

The Ambulance Service reserve the right to exclude individuals from the GoodSAM program where, at their sole discretion, they believe the individual has breached the Code of Conduct, or it is believed that the individual's involvement with the program is not appropriate.

This Code of Conduct may be amended by GoodSAM as required, and in consultation with the Ambulance Services. The amended Code of Conduct will be published on the GoodSAM website and made available via the GoodSAM application.

If you do not agree to abide by the Code of Conduct, you must not act as a responder and must cease use of the GoodSAM application. Your use of the GoodSAM application is considered to be an acceptance of the Code of Conduct as amended from time to time.
